Challenge to Wisconsin's Marriage Amendment

On November 7, 2006, in an overwhelming affirmation of traditional marriage, nearly 60% of Wisconsin voters approved the Wisconsin Marriage Protection Amendment.

On July 31, 2007, Bill McConkey, a UW-Oshkosh professor and now the first president of the Oshkosh PFLAG chapter (Parents, Families and Friends of Gays and Lesbians), filed a lawsuit in Dane County against Gov. Jim Doyle and Attorney General J.B. Van Hollen, in their official capacities, challenging the constitutionality of Wisconsin’s new Marriage Amendment.

Originally, the court ruled that McConkey did not have standing in the case, since he is a heterosexual, married man. However, it did ultimately allow him to challenge the amendment for allegedly dealing with two subjects, which, if true, would be in violation of the Wisconsin Constitution.

Wisconsin Family Council, represented by the Alliance Defense Fund (ADF), filed a friend-of-the-court brief in defense of marriage on Wednesday, March 19, 2008. Oral arguments on the case are set for Thursday, May15 in the Dane County Courthouse.
